On May 23, 2025, the Niskanen Center submitted detailed recommendations to the Department of Justice’s Anticompetitive Regulations Task Force, identifying market-distorting laws and regulations that impact energy, healthcare, and housing. 

Our comment discusses the legal and regulatory barriers that have driven up costs and limited new entry for market participants, from the high-voltage transmission grid to restrictions on healthcare supply, and obscure elevator regulations in the housing industry. We suggest reforms that would benefit American consumers, and urge the Department of Justice and other federal and state decision makers to consider revising and, where necessary, eliminating these anticompetitive systems that stifle the advantages of robust competition across the U.S. economy.
